Indemnification Policy

When becoming a client of PremiusHosting you agree to use the services and facilities that PremiusHosting provides at your own risk, PremiusHosting will not be held responsible for any loss of data or any other commercial related information. Customer agrees that he/she will not hold PremiusHosting responsible for any commercial claims or losses including attorney fees. The customer also agrees that PremiusHosting will not be held responsible for any injuries to a person/s caused from a product or service that PremiusHosting provides, We reserve the right to intervene with any of the sites that are hosted with us for the interest of our clients. PremiusHosting is the only judge to determine what violates this policy.

Acceptable Use Policy (AUP)

Customer agrees to use the services provided by PremiusHosting for law binding purposes only, any kind of violation of the United states law is prohibited, this includes the following but is not limited to copyrighted material, pornography (not allowed on our network) the customer agrees not to hold PremiusHosting responsible for his actions that may result in any harm to any 3rd party, PremiusHosting will not be held responsible for actions of its clients. This policy is enforced on ALL accounts that are hosted on our servers, we will do our best to monitor the content and actions that are being run on our network and will take any necessary measures to make sure all accounts adhere this policy. We also don't allow any advertising for any pornography related sites. If your afraid that your site might not comply with this policy, please contact us before signing up with us, we don't have any problem with adult related sites, we just don't allow pornography. Customer should be aware that the service provided by PremiusHosting may interrupted for some reasons other than the negligence from our side, PremiusHosting will not be held responsible for any damages, loss or injury resulting from such an interruption.

Any content related to hacking, warez and IRC are not allowed on our network, you may allow the downloading of software, audio or video only if you are the copyright owner of these materials, any accounts that are suspended and or terminated because of a violation to this policy are not entitled for any money back guarantees. PremiusHosting reserves the right to determine what violates this policy.

Billing:
Currently we offer monthly and yearly payment options, other payment options can be arranged, please contact the sales department in that regard, we offer a 10 day money back guarantee, in the case that you are not satisfied with any aspect of our service during those 10 days, you may ask for a full refund and we will be glad to provide you with it, please note that the special offers that are sometime promoted on out site might not offer the money back guarantee, please contact the sales department for any questions in that matter, we also accept all major credit cards (Visa, MasterCard, American Express, Diners and JCB)

Our preferred payment method is by Credit card, its the fastest way to get your payment in a secure manner, your contract will be automatically renewed, please notify us prior to your next billing date if you wish to cancel your account. You will be billed on the next date that your account has been activated at, for example if you account was activated on the 10th of January and you signed up for a monthly plan, your next billing date will be on the 10th of February.

Scripts:
You are free to use any of the scripts that come with your account, either them being CGI or PHP, however if any of the script utilizes the server resources in a way that might damage or interrupt the service, we will contact you.

Banned Scripts:
The scripts are not to be run on our servers/network, any account violating this policy will be suspended/deleted.

Port scanners
Hivemail
Telnet or SSH Access Scripts
nph-proxy (and other scripts what operates like proxy)
UBB (Ultimate Bulletin Board, all versions)

FormMail.cgi, FormMail.pl from Matt's Script Archive are not allowed.

IRC:
We currently do not allow IRC or IRC bots to be operated on our servers.

Backup:
We are not responsible for backing up MySQL databases, its the customers responsibility to backup their databases, some of our plans include the backing up of your website, certain special offers may not contain backups, please contact the sales departments for more details in this regard.

Spam -Commercial Advertising - Email:
PremiusHosting DOES NOT allow in any way for its servers to be the source of sending Spam, suspend/delete any account that has been found sending Spam without any notice, in that case the customer is not entitled for any money back guarantees.

Limitation of liability
PremiusHosting will not be held responsible for any kind of damages that my happen for a possible service interruption for any reason, we will also not be held responsible for any damages that result from the corruption or deletion of a website that is hosted on our servers, any violations of this policy should be sent immediately to abuse@premiushosting.com any violations that are found will be dealt with strictly.

DISCLAIMER:
PremiusHosting cannot and will not be held responsible for the actions of the customers hosted on our servers, any violating accounts will be dealt with once they are found, we will also not be held responsible for any damages that might have happened to your site/business, we will not be held responsible for any profit estimates that you or your business would have gained  if your website would be functioning. We reserve the right to change any of the above policies at our discretion.
